Welcome to The Orsus Group’s website, www.theorsusgroup.com, which is owned and operated by The Orsus Group, Inc.  The Orsus Group is a Consumer Reporting Agency that prepares Consumer Reports for our clients as allowed by the federal Fair Credit Reporting Act (FCRA) and other applicable state, federal and international laws. As a Consumer Reporting Agency, we are committed to your privacy and have adopted the following privacy principles pertaining to how we collect, utilize and share information.

The Orsus Group adheres to the Principles of Notice, Choice, Accountability for Onward Transfer, Security, Data Integrity and Purpose Limitation, Access, and Recourse, Enforcement and Liability in regards to the collection, use and retention of personal information. 

The Orsus Group, Inc. is provided, and in turn will provide, sensitive and Personal Identifiable Information about individuals for employment related decisions.  This information may include, but is not limited to, full name, alias/maiden names used, social security number, date of birth, telephone numbers, current and previous addresses, credit information, motor vehicle operator’s license number, professional license information, employment history, academic history, and criminal record history.  We provide employment screening services only to businesses with a permissible purpose and only after they undergo a vetting process.  We release information via telephone, fax, mail, and secure electronic transmission, only to the individual(s) or business(s) that originally requested the service.  Under no circumstances will the personal information collected and maintained in our databases ever be sold or provided to an outside entity for any purpose.  The Orsus Group does not use our databases of consumer information to compile mailing lists for sales or any other purpose.

The Privacy Policy covers the information practices of The Orsus Group, Inc. and describes the principles The Orsus Group follows with regard to information submitted by our clients, their consumers and employees, and to other data that we collect from third parties and other sources in connection with the services we provide.  These information privacy principles have been implemented by all of The Orsus Group’s personnel regardless of their location.  All data shall be collected, stored and used in compliance with applicable law, which may include the Federal Fair Credit Reporting Act (“FCRA”), individual state background screening and privacy laws, the European Union General Data Protection Regulation (GDPR) and other national and international laws.

The Orsus Group hereby confirms our strong policy to protect and maintain the privacy and personal data that we assemble and maintain on behalf of employers concerning consumers.

Notice- Purpose

The Orsus Group collects information on individuals for the purpose of providing the information to employers for employment related decisions.  The information is used by employers to make decisions on whom to hire, retain, promote or re-assign.  It may also be utilized to conduct employee investigations where an employer has a suspicion of work-related misconduct or wrongdoing, or an issue arises as to employee compliance with Federal, State, or local laws and regulations, or any employer policies.

Prior to having The Orsus Group conduct employment screening on a consumer, it is always disclosed to the consumer (as prescribed by the Fair Credit Reporting Act, hereinafter “FCRA”) that the information they provided will be used to conduct employment screening for the employer desiring to use it for employment related decisions.  The Human Resources and Security professionals within the employer organization will also use this information.  Prior to receiving information from the Orsus Group and in accordance with the FCRA, each employer must provide a certification to The Orsus Group that it will only use The Orsus Group’s services for employment purposes or other permissible purpose under the FCRA and that it will comply with all applicable State and Federal regulations and obligations.

Choice- Right to Object

The Orsus Group gives consumers a choice for the collection of information by virtue of the fact that the information is only collected with the consumer’s explicit consent (as required by the FCRA).  The information collected is only utilized for the purposes described above in the section on “Notice”.  Consumers are given a choice to opt-out of having their personal information collected by way of a disclosure form provided to them by our client (their prospective or current employer) prior to a background investigation report being procured.  The consumer can opt-out by not signing the disclosure, thereby stating they do not give their consent to have their personal information collected.  By consenting to the procurement of a background investigation report, and submitting information to our client, the consumer is agreeing to allow The Orsus Group to disclose information about them to our client, and to sharing their information with our subcontractors.

If you are a European Union resident or reside in other countries where The Orsus Group is conducting business, you may choose not to submit personal information to The Orsus Group through our site or through forms provided by our client for that purpose. You have been provided a consent form either by us or our client. By filling out and submitting the consent form you expressly agree to provide personally identifying information and you consent to our use of that information in accordance with this policy.

Accountability for Onward Transfer

In connection with preparing Consumer Reports for our clients, we may employ other companies and individuals as subcontractors to complete parts of the background screening process on our behalf. Subcontractors are contractually obligated to use and maintain the confidentiality of personal information in a manner consistent with this policy. These companies and individuals may not share any such information with any third party, other than their subcontractors, The Orsus Group’s subcontractors or The Orsus Group. Except as described in this policy or required by law, we will not use or otherwise disclose any of the Personal Identifiable Information that you provide or that we collect from third parties or other sources.  Note however, that The Orsus Group may be required to disclose information that we collect in response to a lawful request by public authorities, including to meet national security or law enforcement requirements.

Access

The Orsus Group provides access to consumers on all data collected about the consumer in order to allow the consumer the reasonable opportunity to ascertain what personal data The Orsus Group possesses about the consumer.  The consumer has the opportunity to correct, amend, or delete information that is inaccurate or incomplete.  For the consumer’s protection, The Orsus Group will require proof of identity, including proper verification and confirmation that he/she is the individual who is entitled to request access before providing information.  Disclosure is provided under the terms of the FCRA.  Under all circumstances a consumer is entitled to a copy of his/her report, including a consumer who is a citizen of the EU.  In some circumstances, The Orsus Group may charge a reasonable fee, where warranted, for access to personal information.

Security

The Orsus Group has taken and will continue to take appropriate measures to protect Personal Identifiable Information from loss, misuse, and unauthorized access, disclosure, alteration or destruction.  Personal data transmitted to or from The Orsus Group system is protected by a 128-bit SSL encryption on a secured server for data transmitted over the Internet.  All employees are kept up-to-date on The Orsus Group’s security and privacy policies.  Finally, the servers that are used to store Personal Identifiable Information are kept in a secure environment.  Access to those servers and data is strictly limited to authorized personnel of The Orsus Group.

Data Integrity

The Orsus Group only collects data that is strictly necessary for the purposes listed under the section on “Notice.”  The data includes information that is necessary to identify the consumer for purposes of collecting employment related information.  In accordance with the FCRA, The Orsus Group makes every reasonable effort to assure maximum possible accuracy of the information collected.

Consumer reports are retained by The Orsus Group a maximum of five (5) years in connection with FCRA or other applicable law. Consumers may opt out of The Orsus Group receiving information about them by not consenting to the Consumer Report (background screening report) with their prospective or current employer (our Client).  In general, once a consumer has consented to such a report, The Orsus Group retains the information on file for the five (5) year period.

Information sources that may be used in producing Consumer Reports are not maintained by The Orsus Group, therefore The Orsus Group cannot guarantee that the information from such sources is current or accurate.   A consumer may exercise their right to access and correct information in their file or dispute information in their file, as allowed the FCRA and the Global Data Protection Regulation (GDPR). The Consumer Financial Protection Bureau’s Summary of Rights document provides a list of consumer rights and the Fair and Accurate Credit Transaction Act (FACT Act) also includes additional rights.  See the Consumer Financial Protection Bureau’s Summary of Rights document for more detailed information. If you are a European Union Data consumer, you have the right to have your personal information removed from our system under some circumstances.  Contact your prospective or current employer (our client) that requested we prepare the Consumer Report on you to request removal.  If you need help contacting the employer (our client), please contact The Orsus Group toll free at 877-575-1476, extension 8300.

Enforcement & Liability

The Orsus Group commits to assure compliance with this Privacy Policy as well as all other internal processes related to security, privacy, and confidentiality.  Individuals and clients are encouraged to contact us directly at any time to address any concerns regarding this or any other policy, generally as well as any specific concern or dispute, regarding information we have prepared.  We will investigate and attempt to resolve any complaints and disputes regarding use and disclosure of Personal Information in accordance with this Privacy Policy.  In the event a dispute regarding the information we reported is not resolved through our courses of action, The Orsus Group agrees to cooperate with an independent third-party resolution provider where the applicable law or private sector initiatives so provide.
